Description

The aim of this course is to provide students with a critical, comparative perspective, both from a theoretical and practical vantagepoint, in regard to the development and construction of domestic and international legal systems that are designed to recognize and protect the human rights of Indigenous peoples and Indigenous communities. The history and legal frameworks surrounding the rights of indigenous peoples will be extensively explored in relation to the United States, Canada, New Zealand, Australia, and other countries with indigenous populations around the world. The class will teach students to look beyond how things are done in the United States and to examine successes and failures in other domestic systems, regional systems and at the international level, so as to learn from these diverse experiences and approaches to defining indigenous rights, and to be creative and adaptive when they craft their own legal and policy solutions for their clients asserting their indigenous rights under domestic and international law.
