The penalty's efficacy as public policy, as reflected in recent legislative and electoral developments will be discussed. The course will begin with general constitutional principles and then examine topics specific to capital punishment cases, e.g., the selection of death qualified jurors, sentencing procedures and evidence, and the availability of post-conviction relief. Course materials will emphasize federal constitutional law and some secondary sources of current interest.
