Description

This non-exam GPA course is an advanced ADR seminar in which 6-8 guest speakers over the course of the semester will present their cutting edge ADR research through published scholarly papers and works-in-progress. The goals of the seminar are to expose students to new issues and original thinking in the ADR field, to give them an appreciation of what good scholarship in ADR looks like, and to help them bridge the gap between the theory and practice of ADR.

On days when speakers will be presenting, the first hour of class will be a seminar format in which the students and the presenter will have the opportunity to discuss the presenter's work in more depth. The second hour of the course will be a public talk open to all students, faculty, and the wider Bay Area practice community. An optional networking reception will follow. Students will write response papers to three of the presentations (a total of 6,000 - 8,000 words across all three response papers) and also be required to draft thoughtful questions for the presenters in advance. Tentative topics for speaker presentations in Spring 2023 (subject to change) include: Restorative justice; the psychology of ADR; international commercial and investment arbitration; dispute resolution in the Metaverse; online dispute resolution; dispute systems design; reflective mediation practice; and diversity, equity and inclusion in ADR.
