Description
CALIFORNIA COMMUNITY PROPERTY is sensitive to the current bar exam and to the upcoming Nextgen UBE bar exam. Course materials cover the California family code and other relevant state statutes, appellate cases, Judicial Council Forms, and hypotheticals. Topics in the first half of the course include marriage and cohabitants' rights, dissolution process, community property, separate property, transmutations, and commingling of contested types of property such as bank accounts, separate property businesses, separate property investment accounts, credit acquisitions (cars and houses), deferred earnings, stock options, and cryopreserved genetic materials. Topics in the second half of the course include spouses' rights to manage property, liability for debts, fiduciary duties of spouses toward each other, the California Premarital Agreement Act, the California Domestic Violence Prevent Act, the emerging field of family torts, and remedies for fraud, oppression, and malice (all defined under the state penal code).
